User Agreement



1. Definitions


In this User Agreement, the words below have the following meanings assigned to them:
1.1 “we”, “us”, “our” and “Liberty” means Liberty Holdings Limited.
1.2 “website” means the Liberty Properties website (libertyproperties.co.za)
1.3 “you” and “your” means the user of the website.

2. Your consent


Your use of the Liberty Properties website is subject to the conditions set out below. These conditions may change from time to time so please familiarise yourself with this Agreement regularly.

3. Warranties


3.1 You warrant your identity (i.e. you are who you say you are) and that you can prove your identity should we require you to do so.
3.2 Liberty Holdings reserves the right to refuse to provide services to you if we are unable to verify or authenticate any information you provide to us.
3.3 You will keep your login name and password confidential and you will not divulge your login name or password to anyone nor allow others to use them. (Where applicable)
3.4 Any use of the login name and password by any person shall be deemed to be use by you. (Where applicable)
3.5 We will not ask you to disclose your password in an unsolicited phone call or written correspondence. (Where applicable)

4. Full disclosure of all relevant facts


4.1 You guarantee that all information you provided at any time to Liberty Holdings via this website, in writing, or to the staff servicing our call centres, will be true and correct.
4.2 You guarantee that you have fully disclosed all material facts. Any breach of your contractual duties under this Agreement may lead to the contract or any transactions arising from the contract being rendered void.
4.3 Liberty Holdings will need certain personal and financial information from you. It is in your best interest to keep the information up-to-date and accurate.

5. Electronic transactions, communication and records


5.1 You accept the risk of choosing electronic communication as the channel to be utilized by the parties. You authorise Liberty Holdings to act on the information that you send electronically. You further agree that all records will be stored electronically by Liberty Holdings and such electronic record will constitute conclusive proof of the contents of such record, unless you prove otherwise.
5.2 Any email sent to you will be deemed to have been received by you upon dispatch by Liberty Holdings.
5.3 We take all reasonable steps to protect your personal information and maintain confidentiality, including the use of encryption technology. However, we cannot guarantee the security of any information you transmit to us online and you do so at your own risk.

6. What do we do with the information we collect?


6.1 Liberty Holdings is committed to keeping your information confidential. We will use it to personalise your experience, service your policy, and to directly communicate with you.
6.2 We will disclose information when required to do so (1) by any regulatory authority (like the Financial Services Board) and the regulators they appoint for the various financial sectors (2) by any stock exchange and its related clearing house (3) to comply with any regulation passed under the relevant legislation, or any legal process (4) to protect and defend Liberty Holdings' rights and property (including Liberty Holdings' intellectual property).

7. Parties other than Liberty Life also collect information


Some advertisers or websites that have links on our website may collect personal information about you when you access or use their links. Liberty Holdings does not control the collection or use of such information. This document does not apply to these websites and their advertisers.

8. Copyright


This website is the property of Liberty Holdings Limited. The website, the intellectual property and all software are protected by copyright. All rights in the Liberty and Liberty Holdings trademarks, computer code, tools, calculators and devices remain the sole property of Liberty Holdings. Our software or data may not be decompiled, reverse-engineered, or disassembled, or used in any manner whatsoever.

9. Disclaimer


Liberty Holdings' is committed to providing you with the best possible service. However, we are not responsible for:
9.1 Interrupted, delayed or failed transmission, storage or delivery of information due to a power failure, equipment or software malfunction, natural disasters, fire, labour unrest, or any other cause beyond the control of Liberty Holdings.
9.2 Any negligent act or omission by Liberty Holdings.
9.3 Inaccurate or inadequate information obtained from the web site inaccurate information supplied by you.
We are not responsible for any direct or indirect loss or damages that may arise from:
9.4 Any of the events described in this paragraph (no. 2) and the paragraph above (no. 1).
9.5 Your actions or omissions that result in a breach this Agreement.
9.6 Links with other websites over which we cannot control the content of or the products offered on those websites.
9.7 A denial of access to the website should we believe that you are conducting activities that are illegal, abusive, attack the integrity of the site or put Liberty Holdings in disrepute.
9.8 The reliance on the information obtained from this website.

Liberty Properties is a socially responsible corporate brand, actively supporting CSI initiatives that promote education (maths and science in particular), aligned with the CSI strategy of Liberty Holdings.

Our 2011 drive will be directed at enhancing or building schools / school rooms in poorly developed areas.  Schools or sites will be chosen around the catchment areas of our retail, leisure and commercial properties. We are currently sponsoring, together with Grinaker, two edu-tainers to the St Martin's Pre-school in Westehoek Road Geluksdal, near Carnival City on the East Rand. This is an initiative orchestrated through the Bright Kid Foundation. 

Liberty Properties and the people within its ranks have big hearts and a predilection to give, in time and money, to make a real difference to others. Our employees are supported, through our Employee Volunteer Programme, in various community volunteering projects.

Our seven premier shopping centres are all socially conscious in the communities in which they do business.


Sandton City
The massive refurbishment and expansion project has seen reusable building materials being distributed across a number of different charities from Society for Animals in Distress to Ma Afrika Tikkun.

Two ongoing initiatives that are enormously rewarding are the Birthday Project at Banakekeleni Haven and Abangani E Nkosini in Alexandra Township where the birthday of every child and caregiver is celebrated throughout the year and an annual Christmas initiative with all proceeds from gift wrapping services and Santa photos going to charity. In 2009, R175 000 was raised for Reach for a Dream. We also support other causes like switching off the buildings landmark ‘cap’ in support of Earth Hour and the creation of a limited edition teddy bear through Build-A-Bear Workshop and a relationship with Lucas Radebe to raise funds for CANSA.
Nelson Mandela Square
The centre implements a meaningful Corporate Social Responsibility Programme that recognises specific social issues and speaks to the emotional language of the Nelson Mandela Square brand.

Part of this drive is an investment in the upliftment of our surrounding communities. Several outreach programmes within the nearby Alexandra Township have been selected as charities of choice for 2011.

A series of events, each associated to a specific charity, are hosted throughout the year to ensure there is sustained benefit after each event. All proceeds from programme sales and donations are directed to these charities. Examples of these are the Handel’s Messiah concert (Women for Peace), the 67 minute Mandela Day Children’s Concert (Nelson Mandela Foundation) and Carols on the Square (Topsy Foundation).
Eastgate
The management, staff and tenants at Eastgate Shopping Centre are involved in a start-up non-profit outfit that is getting kids off the street in Alexandra. Look and Love is the life work of Mamokene Chauke, whose organisation is helping vulnerable street children with food, shelter, clothing as well as access to education and psychological support in a child-friendly environment. The Eastgate team volunteer at the home and its tenants help in a number of ways; from shoes, to a day at the movies to general maintenance at the home.

Eastgate also has a consolidated relationship with two other non-profit organisations – St Giles and Avalon. The centre provides a visible platform and a number of annual interventions in support of both these charities fundraising efforts.
Liberty Midlands Mall
Together with Reach Out, a non-profit organisation, the mall has been intrinsically involved in the development of a community centre in the impoverished neighbourhood of France on the outskirts of Pietermaritzburg. Liberty was introduced to Reach Out when work commenced on the StayEasy Hotel at the Liberty Midlands Mall in the area and the company donated R2,4 million – its largest CSI contribution to date - to the project. The proceeds of several centre initiatives have been donated to Reach Out. Other initiatives include free court space to different charities every month to create awareness and raise funds.
Liberty Promenade
The centre has a dedicated exhibition court for NPO’s and NGO’s to utilise in creating awareness for their relevant causes. The current extension and refurbishment project has produced reusable building materials which have all been donated to the local community and Mitchells Plain schools. Also focused at the local schools is an annual ‘Going Green’ competition encouraging children to care for their environment. Winning schools receive improvements to their premises to the value of R25,000.00 each. Still on green initiatives, Liberty Promenade has partnered with Mondi Recycling in a paper recycling project at the centre. Other annual charitable initiatives include the donation of all wheel clamping monies to the Western Cape Rehabilitation Centre, an Easter Egg Drive for the children’s ward at the Tygerberg Hospital in Bellville and substantial donations to the Mitchell’s Plain Council for a senior citizens event and Christmas Street Market.
Greenacres
Apart from offering its centre court to various charities to showcase their missions, Greenacres supports a number of initiatives throughout the year, some of which include: the popular CANSA Shavathon, sponsorship of the Herald Greenacres Miss PE (which has a strong social responsibility element), the Rotary Tree of Joy for charity gift collection and a gift wrapping service for CANSA.
Alberton City
Alberton City is very much a community centre and its management is pleased to give back to its local communities in meaningful ways. Education and initiatives that support enhanced learning are an important element of the centre’s corporate social investment programme. Alberton City launched 2011 with a handover of stationery packs for each learner at Alberton Primary School.
